Case Results
Our client was hit by a delivery company truck. His injuries included severe ankle fractures resulting in a fusion of the ankle. The medical expert believed there was a risk that our client would have to undergo an amputation of his foot in the future. Our client incurred approximately $40,000 in medical bills and lost wages. Two weeks after a mediation and one week before trial the case settled for $2,318,000.
Our client was a passenger in a small pick-up truck that ran a red light and got hit by a tractor-trailer. Our client suffered a severe and permanent brain injury that severely affects her motor skills. She also sustained internal injuries and multiple fractures. The insurance company for the driver of the pickup paid its $300,000 policy with no argument. The fault of the tractor-trailer driver was strongly contested but the insurance carrier for the tractor-trailer agreed to pay $900,000 after a successful mediation.
In this slip and fall case, the client fell because of a pothole in the parking lot. Because no one saw her fall the defendant denied liability saying that no one could prove how or why she fell. After a week of trial, this case settled for $1,200,000. The defendant offered to settle the case after an electron microscope was used to prove that our client had material from the pothole on the sole of her shoe. This scientific proof that the client had stepped in the hole led the defendant to realize that the pothole had caused the fall and resulting serious injuries.
The subcontractor roofing company that employed our client and the general contractor failed to provide any safety training or safety equipment to our client before ordering him onto a wet shake roof. Our client slipped and fell off the 2-story roof onto concrete. He suffered a serious brain injury that required surgery as well as other internal injuries. After litigation and a settlement conference, the case settled with both defendants for a total of 1.15 million dollars.
*This case would now be a workers’ compensation case due to changes in the law since this case.
The insurance company offered the policy limits of $1,000,000 since its insured was found to be intoxicated after hitting our client. Our client was crossing a one way street when the defendant driver hit him. The collision caused such a massive brain injury that our client remains in a vegetative state. The funds from the settlement will be used to help the family pay for his lifetime medical care.
Our clients, a husband and wife, were passengers in a van broadsided by the defendant’s tow truck which had run a red light. Following extraction from the van, our clients were flown by helicopter to the hospital. The wife suffered multiple spinal fractures. She also underwent laparoscopic surgery for internal injuries. Her orthopaedic surgeon stated that she might need future surgery for her back.
The husband suffered a traumatic brain injury with bleeding of the brain. The bleeding in his brain required an emergency surgery a couple months after the crash. The husband also suffered an injury to his rotator cuff which was treated with therapy. The wife had $72,557 in medical bills and lost wages, and the husband had $120,158 in medical bills and lost wages.
Both cases settled before suit was filed for the remaining insurance coverage of $930,000.
After our client underwent surgery, her doctors failed to notice that a life threatening infection had been caused because the internal surgical incisions had not been closed properly. The infection progressed to sepsis and severely injured our client. At trial a jury found there had been malpractice and the case settled for $500,000.
NEGLIGENT USE OF FORKLIFT RESULTS IN $500,000 SETTLEMENT
Our client was at the defendant’s warehouse to pick up load for delivery. He was walking to the bay where his truck was parked when an employee of the defendant backed a forklift out of a truck and ran over our client’s foot. The driver of the forklift never looked where he was going and the forklift did not have a working “back-up” alarm.
The forklift fractured our client’s leg in multiple places. Our client underwent an open reduction internal fixation surgery of his right tibia and a fibular osteotomy surgery at a later date. The medical treatment cost $44,080.02 and the time lost from work caused $29,548.40 in lost wages. As a result of mediation with the defense attorney and insurance adjuster, the case settled for $500,000.
